The Name of Allah Al-Hakam, Al-Haakim & Al-Hakeem (Part 7) – Sunday 30th Dec. 2012

The most important knowledge is the knowledge about Allaah. Allah (Subhaanahu Wa Ta’aala) has revealed the Qur’aan in order to know Him.

One of the most important names of Allaah is the name Al-Hakam, which means the Judge. Allaah (Subhaanahu Wa Ta’aala) has only mentioned this name once in the Qur’aan but you will see the impact of this name in many verses in the Qur’an, from beginning to end.

Whenever Allaah (Subhaanahu Wa Ta’aala) mentions a name profusely it shows the importance of it in our life. This doesn’t mean that the names only mentioned a few times have no importance in our life. The name Al- Quddoos (The Holy) is only mentioned twice but the Qur’aan is full of the impact of this name.

Allaah (Subhaanahu Wa Ta’aala) is the only true Judge. Why?  Because He is perfect in His attributes and no one deserves to be the true judge unless they are perfect. Allaah is perfect in His Might, ability, strength, knowledge. This is why whatever laws He set for us will be perfect. Whatever He decrees for us will be perfect. Allaah’s judgement and decision, whether legal, universal or is a recompense, are all just and perfect because they are from Allah, the Most High, Most perfect in attributes.

What should our attitude be when we know this fact? How should I deal with the laws and decrees of Allaah (Subhaanahu Wa Ta’aala) ?

A very important impact of believing in the name Al-Hakam: The obligation of seeking the Judgement from Allaah (Subhaanahu Wa Ta’aala) from the Qur’aan and the Sunnah of the Prophet (Salla-Allaahu ‘alaihi wa sallam).

Your Tawheed will not be perfect unless you seek the Judgement of Allah and the Messenger. There are many verses in the Qur’aan that show that guidance and reformation in the land will not be achieved unless you refer to the Qur’an and the Sunnah. If you will not refer to the Qur’aan and Sunnah in all your affairs, you will attain reformation neither in your life nor on earth.

Allaah (Subhaanahu Wa Ta’aala) says in Surah Maa’idah (5:50):

أَفَحُكْمَ الْجَاهِلِيَّةِ يَبْغُونَ ۚ وَمَنْ أَحْسَنُ مِنَ اللَّهِ حُكْمًا لِّقَوْمٍ يُوقِنُونَ

Do they then seek the judgement of (the Days of) Ignorance? And who is better in judgement than Allaah for a people who have firm Faith. 

It is as if Allaah is inquiring to affirm a fact. No one is better than Allaah in His decision. For those certain in faith,  Allaah has the best Hukm. The problem with most people is that there is lack of certainty and belief in Allaah’s attributes.  This is why they do not refer to His judgement.  They have weak faith in His perfect wisdom, knowledge. If they had strong faith in Allaah’s knowledge they would submit themselves to Allaah’s laws. This makes the people prefer man made laws over Allaah’s laws and it makes them impatient when Allaah (Subhaanahu Wa Ta’aala) decides something for them. This is the decree of Allaah and we must accept.

Allaah (Subhaanahu Wa Ta’aala) says in Surah Mulk,

أَلَا يَعْلَمُ مَنْ خَلَقَ وَهُوَ اللَّطِيفُ الْخَبِيرُ 

”Should not He Who has created know? And He is the Most Kind and Courteous (to His slaves) All-Aware (of everything).”  [67:14]

Al-Lateef is kind and whose knowledge is so subtle that He knows the minute details of everything. Al-Khabeer is the one who knows the secrets of the hearts and the self. Allaah (Subhaanahu Wa Ta’aala) is telling us that He is the one who created everything in this life,  knows everything, and deserves to set the laws. We need to submit ourselves to Him.

Whoever refuses to seek the judgement of Allaah from the Qur’aan and Sunnah, he is considered a hypocrite. This is a very serious matter.

Evidence: Surah An-Nisa Verses 60 to 62:

أَلَمْ تَرَ إِلَى الَّذِينَ يَزْعُمُونَ أَنَّهُمْ آمَنُوا بِمَا أُنزِلَ إِلَيْكَ وَمَا أُنزِلَ مِن قَبْلِكَ يُرِيدُونَ أَن يَتَحَاكَمُوا إِلَى الطَّاغُوتِ وَقَدْ أُمِرُوا أَن يَكْفُرُوا بِهِ وَيُرِيدُ الشَّيْطَانُ أَن يُضِلَّهُمْ ضَلَالًا بَعِيدًا

Have you seen those (hypocrites) who claim that they believe in that which has been sent down to you, and that which was sent down before you, and they wish to go for judgement (in their disputes) to the Taghut (false judges, etc.) while they have been ordered to reject them? But Shaitan (Satan) wishes to lead them far astray. 

وَإِذَا قِيلَ لَهُمْ تَعَالَوْا إِلَىٰ مَا أَنزَلَ اللَّهُ وَإِلَى الرَّسُولِ رَأَيْتَ الْمُنَافِقِينَ يَصُدُّونَ عَنكَ صُدُودًا 

And when it is said to them, “Come to what Allah has sent down and to the Messenger  (Muhammad Salla-Allaahu ‘alaihi wa sallam ),”  you (Muhammad Salla-Allaahu ‘alaihi wa sallam) see the hypocrites turn away from you (Muhammad Salla-Allaahu ‘alaihi wa sallam) with aversion. 

فَكَيْفَ إِذَا أَصَابَتْهُم مُّصِيبَةٌ بِمَا قَدَّمَتْ أَيْدِيهِمْ ثُمَّ جَاءُوكَ يَحْلِفُونَ بِاللَّهِ إِنْ أَرَدْنَا إِلَّا إِحْسَانًا وَتَوْفِيقًا

How then, when a catastrophe befalls them because of what their hands have sent forth, they come to you swearing by Allaah, “We meant no more than goodwill and conciliation!” 

The description of these people is that they claim they believe in the Qur’aan and all what Allaah (Subhaanahu Wa Ta’aala) revealed upon the previous messengers but in their hearts they want to judge by the Taghoot. They want to judge by other than Allaah.

Allaah (Subhaanahu Wa Ta’aala) commanded them not to disbelieve in the Taghoot but the Shaytaan wanted to lead them astray.

Then we see a dispute, when they are called to seek Allaah’s judgement they turn away.  Allaah(Subhaanahu Wa Ta’aala)
clearly states they are Munafiqeen (Hypocrites)!

They claim they are Muslims but when they are called to seek Allaah’s judgement, they refuse. Whoever seeks a judgement other than Allaah will fail miserably. And when they fail they will come SWEARING (This is another attribute of the hypocrites, and you can see this in Surah Tawbah), saying that they only wanted the benefit and to please everyone.

It is reported that these verses were revealed regarding a man from the Ansar. Others say it has to do with a man from the hypocrites. The man disputed with a Jew and the Jew said let us go to Muhammed to settle the dispute. The man refused saying, “Lets go to Ka’b bin Ashraf (another Jew) or a soothsayer”

The Jew knew the Prophet (Salla-Allaahu ‘alaihi wa sallam) didn’t take bribery and because the Jews love money and are miserly, they wanted to go the Prophet. The man refused because he wanted someone he could bribe.

Whoever refrains from referring to the Qur’aan or Sunnah for judgement or prefers another judgement then he has the attribute that agrees with that of the hypocrites.

What is the problem with the hypocrites?

They have weak faith. They don’t magnify Allaah and give Allaah His due estimate. If they really knew who Allaah is they would submit themselves to Allaah and would not hide disbelieving while uttering belief through their tongues. They don’t know who Allaah is, this is why they think they can deceive Allaah! They say we believe but in their hearts they intend something else. They don’t know that Allaah knows what is in their hearts. They are unaware of Allaah’s awareness of their hearts.

The Taghoot is EVERYTHING or EVERYONE which one transgresses His limits in. Ibn Qayyim (Rahimahullaah) said, “It is everything or everyone worshipped other than Allaah, or obeyed other than Allaah, or being followed other than Allaah, or whose judgement is sought other than Allaah”

It can be a stone, it can be a grave, and it could even be a Prophet. The head of the Tawagheet is Iblis. Next are those who are pleased that the people are worshipping them, like in many deviated religions. According to this verse, it is anyone who is judged with other than Allaah’s laws.

يَزْعُمُونَ  is the word which shows they are not believers. They claim they are believers but they aren’t. The attitude of the believers is when the Hukm of Allaah comes they submit, obey, are content. They are the ones who want the Hukm of Allaah to be judged among them. These are the believers.

If we have two people – One is rich, dealing with Riba and knows that this is Haraam and another man who is poor, doesn’t deal with Riba but believes it is very good for the economy of the whole world then who is greater in crime? The poor one though he didn’t deal with it, his heart believed in it. His Aqeedah was corrupt. We are responsible for our hearts! Whoever judges with another than Allah’s judgement then he is not a believer.

Any Hukm which contradicts the law of Allah is Hukm Jahiliyyah. Side Note: There are many travelling laws and traffic laws which the government sets to organize the people. These laws are permissible as long as they don’t contradict Allaah’s laws.

Whoever is called for Judgement to Allaah’s books and the Sunnah of the Prophet (Salla-Allaahu ‘alaihi wa sallam) and he refuses, he is considered a hypocrite. Any hypocrite or reference to hypocrisy which is mentioned in the Qur’aan is referring to the Major Hypocrisy. This brings the person out of the fold of Islam. We call it Nifaaq Al Aqidi -> It is related to the Aqeedah!  He believes something that Allaah (Subhaanahu Wa Ta’aala) didn’t set and this brings him out of the fold of Islam.

Whereas in the Sunnah, whatever the Prophet (Salla-Allaahu ‘alaihi wa sallam) has mentioned regarding hypocrites is practical hypocrisy (i.e Minor hypocrisy). This does not bring a person out of the fold of Islam.
If you want to check yourself, check three things in order not to fall into Major Hypocrisy :-

  1. If a dispute happened and someone said to you, “Let us refer to the Qur’aan and Sunnah”, and you turn away and refuse, this is a sign you are a Major Hypocrite.
  2. If you find in your heart dislike and distress to refer to the Qur’aan and Sunnah then it is a sign you are a major hypocrite. No one knows this feeling except Allaah.
  3. If the person was told, “What you are doing is wrong and the Qur’aan and Sunnah says this,” and he does not obey.

What will happen on the earth if people follow laws other than Allaah’s?

In Surah Baqarah Verse 11 and 12:

 وَإِذَا قِيلَ لَهُمْ لَا تُفْسِدُوا فِي الْأَرْضِ قَالُوا إِنَّمَا نَحْنُ مُصْلِحُونَ 

And when it is said to them: “Make not mischief on the earth,” they say: “We are only peacemakers.” 

أَلَا إِنَّهُمْ هُمُ الْمُفْسِدُونَ وَلَٰكِن لَّا يَشْعُرُونَ

 Verily! They are the ones who make mischief, but they perceive not.

 The context of this verse is about the hypocrites. When they are told not to make mischief on the land they say, “We are only peacemakers.”

They are Mufsidoon because they are not following Allaah’s laws. They are not abiding to the law and judgement of Allaah. The scholars said, “Every judgement other than the Qur’aan and Sunnah mischief will happen in the land.

The hypocrites don’t feel that they are hypocrites; they think they are good and others are bad! This is very serious! As long as a person does not refer to the Qur’aan and Sunnah then there is a mischief in the land. They don’t feel they are hypocrites nor do they KNOW they are hypocrites!!

What should we do in order to come out of this attribute?

To know and learn the law of Allaah! This is a must on us. It is obligatory for us to know the pillars of Islam and Eeman. We have to know the conditions of La ilaha Ilallah, Zakat, Hajj, Siyam, etc.

We have to know about the belief in Allaah, the angels, the decree, etc. The most important pillar is belief in Allaah. This is obligatory we will be asked about in on the Day of Judgement.

We need to know the laws of Allah according to our situation. If you are a teacher you need to know what is Halaal and Haraam regarding your job. As a mother you should know your duty, this is a must on you. We are not excused with ignorance.

Example: The law of inheritance: A father or husband dies. When the father dies the sons and daughters gather and they distribute the inheritance without referring to the Qur’aan. Allaah (Subhaanahu Wa Ta’aala) mentioned the detail of the share of every individual in Surah Nisaa’. When these people distribute the inheritance without referring to the Qur’aan someone will take more than he should and someone may be deprived and this is a kind of mischief in the land which Allah forbade us from.

If you want to make reformation refer to the Qur’aan and Sunnah, what Allah (Subhaanahu Wa Ta’aala) and the Prophet (Salla-Allaahu ‘alaihi wa sallam) said we will should stick to and hold fast to. If the knowledge is difficult to understand, go to the Judge who will judge according to the Qur’aan and Sunnah. We are not excused.

Many people think that the law of Allaah (Subhaanahu Wa Ta’aala) is voluntary. They don’t feel its importance.

Do only the hypocrites make mischief in the land?

No, even Muslims can if they don’t refer to the Qur’aan and Sunnah in their disputes and affairs. Evidence: Surah A’raf Verse 56:

وَلَا تُفْسِدُوا فِي الْأَرْضِ بَعْدَ إِصْلَاحِهَا وَادْعُوهُ خَوْفًا وَطَمَعًا ۚ إِنَّ رَحْمَتَ اللَّهِ قَرِيبٌ مِّنَ الْمُحْسِنِينَ

And do not do mischief on the earth, after it has been set in order, and invoke Him with fear and hope; Surely, Allaah’s Mercy is (ever) near unto the good-doers.

Allaah (Subhaanahu Wa Ta’aala) is advising the believers not to make mischief in the land after its reformation. When Allaah (Subhaanahu Wa Ta’aala) sent books and messengers Allaah reformed the land. After sending the Qur’aan and Messenger, we should not  make mischief by opposing the Risalah or the laws from the Qur’aan. If you want to keep it reformed then abide by Allah’s laws.

If the people do not refer to the Qur’aan and Sunnah then a lot of evil will happen in the land and we can see the impact of this nowadays. We see floods, hurricanes, earthquakes, and sicknesses with thousands of people being killed. Evil is happening and is increasing due to the people not abiding to the Qur’aan and Sunnah.

Allaah (Subhaanahu Wa Ta’aala) said in Surah Rum Verse 41:

ظَهَرَ الْفَسَادُ فِي الْبَرِّ وَالْبَحْرِ بِمَا كَسَبَتْ أَيْدِي النَّاسِ لِيُذِيقَهُم بَعْضَ الَّذِي عَمِلُوا لَعَلَّهُمْ يَرْجِعُونَ
Evil (sins and disobedience of Allaah, etc.) has appeared on land and sea because of what the hands of men have earned (by oppression and evil deeds, etc.), that Allaah may make them taste a part of that which they have done, in order that they may return (by repenting to Allaah, and begging His Pardon).

 

The earth is not bringing forth a lot of vegetation, not as much as before. There are droughts, and this is only because of what people have earned of sins and referring to other than Allaah’s book in judgement.

Allaah (Subhaanahu Wa Ta’aala) says in Surah Shura Verse 30:

وَمَا أَصَابَكُم مِّن مُّصِيبَةٍ فَبِمَا كَسَبَتْ أَيْدِيكُمْ وَيَعْفُو عَن كَثِيرٍ

And whatever of misfortune befalls you, it is because of what your hands have earned. And He pardons much. 

Allaah (Subhaanahu Wa Ta’aala) says in Surah A’raf Verse 96:

وَلَوْ أَنَّ أَهْلَ الْقُرَىٰ آمَنُوا وَاتَّقَوْا لَفَتَحْنَا عَلَيْهِم بَرَكَاتٍ مِّنَ السَّمَاءِ وَالْأَرْضِ وَلَٰكِن كَذَّبُوا فَأَخَذْنَاهُم بِمَا كَانُوا يَكْسِبُونَ

And if the people of the towns had believed and had the Taqwa (piety), certainly, We should have opened for them blessings from the heaven and the earth, but they belied (the Messengers). So We took them (with punishment) for what they used to earn (polytheism and crimes, etc.).  

This is a promise from Allaah (Subhaanahu Wa Ta’aala) that if you believe and fear Allaah, He will for sure bring the Barakah in everything.

Example of not following the law of Allah:

There are many who force the girl to marry her cousin and consider it a crime if she gets married to someone else. This is against the laws of Allaah.

What did Allaah say about the people who feel dislike and discontentment when the laws of Allaah come?

Surah Muhammad Verse 9:

ذَٰلِكَ بِأَنَّهُمْ كَرِهُوا مَا أَنزَلَ اللَّهُ فَأَحْبَطَ أَعْمَالَهُمْ

That is because they hate that which Allaah has sent down (this Qur’aan and Islamic laws, etc.), so He has made their deeds fruitless.

Allaah (Subhaanahu Wa Ta’aala) is referring to the hypocrites; they hate what Allaah had revealed of the laws in the Qur’aan! Accordingly, Allaah rendered their deeds fruitless. All they did was they hated what was in the Qur’aan. ‘I don’t want to wear this hijab, I don’t like it.’ Her mother tells her to wear it but she doesn’t like it. They don’t say it but it is in their hearts.

We should not hate the law of Allaah; it is the law of the one who is perfect in His attributes. He wants the good for us this is why He made this law for us.

Ibn Uthaymeen (Rahimahullaah) said, “If the person didn’t hate it but preferred the love of the Dunya while understanding that the law of Allah is good, she is NOT a disbeliever”

The Khawaarij (a sect) went far astray saying that anyone who doesn’t abide the law of Allaah is a disbeliever and they make his blood lawful. They kill Muslims because they are not wearing hijab. We don’t want to accuse anyone of being a disbeliever or hypocrite. No one knows the matter of the heart except Allaah. Don’t accuse anyone of being a disbeliever or hypocrite as this is a matter related to Allaah.

  • DON’T JUDGE PEOPLE

You have to be careful of yourself; you don’t want to take the attribute of the hypocrites.  Surah An-Nur [Verses 47-52]:

 They (hypocrites) say: “We have believed in Allaah and in the Messenger (Muhammad, Salla-Allaahu ‘alaihi wa sallam), and we obey,” then a party of them turn away thereafter, such are not believers.  [24:47]

And when they are called to Allaah (i.e. His Words, the Qur’aan) and His Messenger (Salla-Allaahu ‘alaihi wa sallam) to judge between them, lo! a party of them refuse (to come) and turn away. [24:48]
But if the right is with them, they come to Him willingly with submission. [24:49]
Is there a disease in their hearts? Or do they doubt or fear lest Allaah and His Messenger (Salla-Allaahu ‘alaihi wa sallam) should wrong them in judgement. Nay, it is they themselves who are the Zalimun (polytheists, hypocrites and wrong-doers, etc.). [24:50]
The only saying of the faithful believers, when they are called to Allaah (His Words, the Qur’aan) and His Messenger (Salla-Allaahu ‘alaihi wa sallam) to judge between them, is that they say, “We hear and we obey.” And such are the prosperous ones (who will live forever in Paradise). [24:51]
And whosoever obeys Allah and His Messenger (Salla-Allaahu ‘alaihi wa sallam), fears Allaah, and keeps his duty (to Him), such are the successful ones. [24: 52]

Allaah (Subhaanahu Wa Ta’aala) judged upon them that they are not believers. If they are called to judge according to the Qur’aan and Sunnah, they turn away. If the truth is on their side they come willingly, they don’t believe it is the best, only because it is according to their desire.

This should make us feel scared. Do they doubt in the law of Allaah? They think that if they abide to the Qur’aan and the Sunnah they will not get their rights. Allaah (Subhaanahu Wa Ta’aala) tells us they are Thalimoon. These are the oppressors, the wrongdoers.

The Prophet (Salla-Allaahu ‘alaihi wa sallam) said, “Thulm is a darkness on the Day of Judgement”

How can they doubt in the law of Allaah? How can Allaah, whose attributes are perfect, wrong them? How can they think these bad thoughts about Allaah?

The attributes of the believers is that whenever they are called to the Qur’aan and Sunnah, they say WE HEAR and WE OBEY. This is the sign of  belief. They go willingly to the Qur’aan and Sunnah and seek judges who judge according to the Qur’aan and Sunnah. These are the believers who magnify the law of Allaah.

When Ubadah ibnu Samit, the chief of the Khazraj, was dying he advised his nephew, “You have to listen and obey at times of ease and hardship, when you feel energetic, and when you feel you don’t want to take an action. You have to train your tongue to speak the truth. Don’t go against those who are in authority unless they openly command you to commits acts which goes against the book of Allaah and the Sunnah”

Qatadah said, “We were told that Abu Dardaa (Radhia-Allaahu ‘anhu) said, “There is no Islam except through obedience to Allaah and there is no goodness except in the Jam’ah. Sincerity is to Allah and His Messenger and to the Khalifah and all the believers.

And we were told that Umar ibn Khattab (Radhia-Allaahu ‘anhu) said, “The bones of Islam are: 1) La ilaha illa Allaah  2) Establishing the Salat  3) Paying the Zakat  4) Obeying those whom Allah has given the authority over the Muslims”

Even though we see things we dislike, we obey as long as we are not commanded with disobedience to Allaah.  Allah says in Surah An-Nur that these are the winners on the Day of Judgement.
